This California Consumer Privacy Act (“CCPA”) Privacy Policy (“Privacy Policy”) is provided by AssuranceAmerica Corporation, AssuranceAmerica Managing General Agency, LLC (CA DBA  AssuranceAmerica Managing General Insurance Agency, LLC), AssuranceAmerica Insurance Company, InsureMax Insurance Company and Trustway Services, LLC DBA AADirect (CA DBA AssuranceAmerica Insurance Agency), collectively “AssuranceAmerica.” This Privacy Policy explains how AssuranceAmerica collects, uses, and discloses Personal Information about California residents. This Privacy Policy also explains certain rights that California residents have under the CCPA. This Privacy Policy applies to California residents only.

Collection and Disclosure of Personal Information

The specific Personal Information that we collect, use, and disclose relating to a California resident covered by the CCPA will vary based on our relationship or interaction with that individual. This Privacy Policy does not apply with respect to information that we collect about California residents who apply for or obtain our products and services for personal, family, or household purposes subject to the Gramm-Leach-Bliley Act. For more information about how we collect, disclose and secure information relating to these customers, please refer to our general Privacy Policy.

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“personal information”). We may collect, and within the last twelve (12) months we may have collected, the following categories of personal information from the sources identified below for the business and commercial purposes indicated, and shared such categories of personal information with the specified categories of third parties:

We may also use this information to verify your identity, monitor your activity for potential fraud or identity theft, and to provide you with products and services that fit your needs.
Certain Characteristics Your marital status, age, gender or similar characteristics. We may use this information for regulatory purposes, to service your policy or product, or create a customer profile in order to target advertising and products that may be most relevant to you.
Commercial information Records of your personal property such as your vehicle or home, products or services of ours that you have used or considered in the past, transactional information, or other purchasing or consuming histories or tendencies. This information may be used for regulatory purposes and to create a customer profile in order to provide you with products and services that fit your needs.
Internet or other electronic network activity information Your browsing history and recording of your session activity per our cookie consent policy, stored pixels, or other information regarding your interactions with our own website, applications, or advertisements. We may use this information to track our website usage, optimize site layout and your experience, and also to create a customer profile in order to provide you with products and services that fit your needs.
Geolocation data IP address, transaction location, and other information that could be used to identify the location of an electronic device that you are using. This information may be used for regulatory purposes, creating targeted communications, offering you products or services that fit your needs, determining your driving habits and to prevent fraud.
Biometric information Fingerprint, Face ID, Eye print, voiceprint, palm scan. We may use this information to service your policy or product, create a customer profile or to prevent fraud.
Audio, electronic, visual, or similar recorded information Audio or video recordings of our phone conversations, electronic records of our chat sessions. This information may be used for regulatory, security and quality assurance purposes. We may also use this information to prevent fraud.
Inferences drawn from any of the information identified here to create a customer profile Information that we infer about you based on observed product usage and responses to our surveys. We use this information to optimize the products and services we offer and also to create a customer profile in order to provide you with products and services that fit your needs.

 

We may have collected such Personal Information from the following sources:

  • Directly from California residents or their representatives;
  • Third-party companies or organizations from whom we collect personal data as part of providing products and services, completing transactions, and supporting our everyday operations and business development;
  • Third-party companies or organizations that provide data to support activities such as fraud prevention, underwriting and marketing;
  • Public records or widely available sources, including social and news media or federal, state, or local government sources;
  • Consumer data resellers;
  • AssuranceAmerica’s affiliated and subsidiary companies. For a list of AssuranceAmerica’s affiliates and subsidiaries, please see our general Privacy Policy; and
  • Indirectly from California Residents, for example regarding activity on our website and mobile app or through social media.

 

We may have disclosed some of the above categories of Personal Information for business purposes to the following third-parties:

  • Vendors and service providers that provide services to AssuranceAmerica as part of providing products and services, completing transactions, and supporting everyday operations, such as website hosting, data analysis, payment processing, information technology and related infrastructure, fraud prevention and data security, customer service, rating and underwriting, claims administration, marketing activities, and improving customer experience. Please note that information obtained from a report prepared by an insurance-support organization may be retained by the insurance-support organization and disclosed to other persons.
  • Third-party companies or organizations in connection with routine or required reporting, including consumer reporting agencies;
  • Our affiliates and subsidiaries. For a list of AssuranceAmerica’s affiliates and subsidiaries, please see our general Privacy Policy;
  • Individuals or organizations that represent California residents, such as a power of attorney, guardian or legal counsel;
  • Other third-parties authorized by our customers to access their Personal Information, and those authorized to conduct transactions online and via mobile devices and to support our products and services; and
  • Government agencies, including law enforcement, to support regulatory and legal requirements.

 

Use of Personal Information

In the past 12 months, we may have used Personal Information relating to California residents for one or more of the following business purposes:

  • Performing services and offering products, including maintaining or servicing products and services, processing applications and payments, providing customer service, verifying your identity, rating and underwriting, claims administration, processing transactions and supporting everyday operations;
  • Engaging in advertising or marketing activities;
  • Preventing, detecting and responding to fraud or other security incidents;
  • Undertaking activities, including internal research and analysis, to derive consumer insights and to maintain or enhance the quality of our products and services, including our website;
  • Maintaining the integrity and the functionality of our information technology systems;
  • Responding to legal requests for information, such as subpoenas, warrants, and court orders; and
  • Complying with other legal requirements, such as maintaining information for required retention periods.

 

Use of Cookies and Other Technologies

AssuranceAmerica and third parties use cookies and other technologies to track your experience on our websites and mobile applications, conduct analytics, and show you personalized advertising.

 

Sale of Personal Information

AssuranceAmerica does not sell any of the Personal Information that we receive or collect from California residents. Therefore, AssuranceAmerica does not offer an opportunity to opt-out of selling your Personal Information at this time.

 

Rights Under the CCPA

If you are a California resident, you have the right to:

  1. Request that we disclose to you the following information covering the 12 months preceding your request (“Request to Know”):
    • the categories of Personal Information that we collected about you and the categories of sources from which we collected such Information;
    • the business or commercial purpose for collecting Personal Information about you;
    • the categories of Personal Information about you that we disclosed to third-parties for a business purpose and the categories of third-parties to whom we disclosed such Personal Information; and
    • the specific pieces of Personal Information we collected about you.
  2. Request that we delete Personal Information that we collected from you, subject to applicable exceptions (“Request to Delete”).
  3. Be free from unlawful discrimination for exercising your rights under the CCPA.

 

Authorized Agents

You also have the right to use an authorized agent to make a request under the CCPA on your behalf. Your agent will need to submit documentation, such as written permission or a valid California Power of Attorney, along with their request proving the legal authority of the authorized agent making the request on their behalf. We may deny the agent’s request if the agent does not submit proof that they have been authorized by you to act on your behalf.

Parents/legal guardians making requests on behalf of their minor children will need to include a description of their relationship to the minor child and include a certified copy of the birth certificate or legal documentation to provide proof of their status.

 

How to Make Requests

If you are a California resident (or an authorized agent thereof), you may make a request for the disclosures described above or make a request to delete Personal Information we collected from you using one of the below methods.

  1. Emailing us at customer_service@aainsco.com to initiate your request.
  2. Calling us toll-free at 1-800-450-7857 to initiate your request.
  3. Mailing a written request to the following address.  Your written request must include your name, your policy number or other account number, address, the nature of your request and a phone number where you can be reached.

Upon submission of your request, we will take steps to verify your identity or, if applicable, the authorized agent. This may be accomplished by asking you to verify details about your policy and information we have on file.

We will work to process all verified requests within 45 days. If we need an extension in order to process your request, we will reach out to you.

Privacy and data protection laws, other than the CCPA, apply to much of the Personal Information that we collect, use, and disclose. When these laws apply, Personal Information may be exempt from, or outside the scope of, Requests to Know and Requests to Delete. As a result, in some instances, we may decline all or part of a Request to Know or Requests to Delete related to this Personal Information.

In some instances, we may not be able to honor your request; for example, we will not honor your request if we cannot verify your identity or confirm that the Personal Information that we maintain relates to you, or if we cannot verify that you have the authority to make a request on behalf of another individual. Additionally, we may not honor your request where an exception applies, such as where we are required to maintain the information to comply with state or federal law or where the Personal Information that we maintain about you is not subject to the CCPA.

We will advise you in our response if we are not able to honor your request. We will not provide any specific pieces of information if the disclosure presents the possibility of unauthorized access that could result in identity theft or fraud or unreasonable risk to data or systems and network security.

 

Changes to This Privacy Policy

We may change or update this Privacy Policy in the future. When we do, we will post the revised CCPA Disclosure on our website located at https://assuranceamerica.com/privacy.html. This CCPA Privacy Policy was last updated and became effective on the following date: August 26, 2024.
